Task 4. At a court hearing in a civil case on the claim of Stupina A.V. to Lagutina K.V. for the collection of a debt in the amount of 155 thousand rubles. a receipt on behalf of Lagutina appeared as evidence. The latter claimed that she did not comply with the text of the receipt. In this regard, a handwriting examination was ordered. In the court´s ruling on the appointment of an examination, the expert was asked only about the executor of the handwritten text of the receipt. The expert who was entrusted with carrying out the examination filed a petition to clarify the question, i.e. whether the signature on behalf of Lagutina in the specified receipt was also subject to examination. However, no response was received to this petition, but after 3 months the court ordered a new examination to examine the signature on the same receipt. The examination was called “repeated” because the first one was “not fully carried out.” Indicate whether the expert has the right to examine on his own initiative an object about which there is no question in the court’s ruling or ruling. How should the expert’s interaction with the body that appointed the examination be organized? In this case, is the second examination repeated?
Problem 5. On the evening of June 10, 2018, returning from work and passing by the apartment of her neighbor, lonely pensioner I.V. Burkov, Svetlana Proshina saw a note on the door of his apartment: “I left with a friend for the dacha. I´ll be there on the 15th." The note seemed suspicious to Proshina, since the neighbor had practically not been away for a long time for the last two years due to a leg illness, and the day before he had complained of general malaise. As far as Proshina knew, the pensioner had neither a dacha nor friends with a dacha, so the alarmed neighbor called the police. Police officers who arrived at Proshina’s call found in the apartment the corpse of Burkov I.V. with a noose tied around his neck, lying on the floor in the bathroom, randomly scattered things in the living room, and three empty picture frames. According to the neighbor, numerous orders and medals that Burkov had are also missing
